E-Mail: info@tryit-app.com
Registergericht: Amtsgericht Stendal, HRB 37276

§ 2 Was Try It leistet
(2) Try It hat drei Stufen:
§ 8 Deine Inhalte
(1) Alles, was du hochlädst oder in Try It anlegst — Fotos deiner Kleidungsstücke, Outfits, Notizen, Reisepläne —, bleibt deins.
§ 9 Was du nicht darfst
Du entscheidest selbst, was du damit machst.
(5) Try It ersetzt keine eigene Datensicherung.
Änderungen an Try It selbst regelt § 2 Absatz 6.

§ 1 Who we are, what these terms apply to
(1) Try It is a service provided by

Register court: Amtsgericht Stendal, HRB 37276

In what follows we call ourselves “we” or “Try It”, and we call you “you”.
(2) These terms apply to the use of Try It on every access route: through the website and web app at tryit-app.com and through the Try It app for iOS. They apply to free use just as they do to paid subscriptions.
(3) They apply towards consumers and towards traders. A consumer is any natural person who enters into the contract for purposes that can predominantly be attributed neither to their commercial activity nor to their self-employed professional activity. A trader is anyone who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity. Where individual provisions apply only to one group or the other, this is stated expressly.
(4) Terms of your own apply only if we have expressly agreed to them in text form.
(5) If you buy a subscription through the App Store, the terms that Apple imposes on you there additionally apply to that acquisition through the App Store. § 15 governs the particularities of this route. We do not agree that those third-party terms take precedence over the present terms; your rights under the contract with us and under the law are not restricted by this.
(6) The Creator programme is not the subject of these terms. Participation in it is governed by separate Creator Terms, which we make available to you before admission and which you accept separately. Without such admission, no claims to commission or to participation arise from these terms.
(7) The contract language is German. We additionally make these terms available in English and Spanish. The German version is the original; the other versions are translations of it, and the German version prevails. Where a translation departs from the German version, the version more favourable to you applies if you are a consumer.
§ 2 What Try It provides
(1) Try It is a digital wardrobe. You capture your own items of clothing as photos, Try It automatically cuts out the background and tags them, you put together outfits from them yourself and save them. Depending on the plan, there is also AI-assisted style advice (“Noé”) and travel packing planning. Try It is a digital service within the meaning of § 327 paragraph 2 sentence 2 number 1 of the German Civil Code (Bürgerliches Gesetzbuch).
(2) Try It has three tiers:
- Free — free of charge, without a subscription and without a means of payment. You can add up to 20 items and have 10 requests to Noé per month. Deleting items does not free up space. This does not apply if you have ever had a paid subscription: in that case, only the items you still have count (§ 6(9)).
- Pro — paid subscription. The item limit of the Free tier no longer applies: you can add an unlimited number of items. You have 150 requests for Noé and weather per month, plus the travel planner and the HD export templates. Pro includes one wardrobe.
- Atelier — paid subscription. It includes everything in Pro; instead of 150, you have 500 requests for Noé and weather per month, and you can maintain up to five wardrobes, kept separate from one another.
Every message you send to Noé counts as one request. The weather forecast in the travel planner counts at most once per trip and calendar day (based on German time). If you open the same trip several times on the same day, this costs nothing extra. Weather that Noé looks up herself for an answer does not count extra. Your request allowance renews on the first day of each month.
(3) The exact limits and features of the tiers are stated, at the time of your order, on our pricing page and — where you buy through the App Store — in the product description in the App Store. This information forms part of the contract.
(4) We make the service available to you immediately after the contract is concluded, unless otherwise agreed. It has been made available as soon as you can use it with your account.
(5) During the term of the contract we provide you with the updates that are necessary to keep Try It in conformity with the contract, including security updates, and we inform you about them. If you do not install an app update we have provided within a reasonable period, we are not liable for defects that arise solely from this — provided that we informed you about the update and about the consequences of a failure to install it and that the installation instructions were not defective.
(6) Beyond what is necessary to maintain conformity with the contract, we may change Try It only for a valid reason. Valid reasons are: adaptation to a changed technical environment, the closing of security gaps, the further development of Try It through new or changed features, the discontinuation or change of a service provided by a service provider we need for Try It, and adaptation to a changed legal situation or to an administrative or judicial decision. No other reasons entitle us to make a change. You incur no additional costs as a result of such a change. We inform you about the change in a clear and comprehensible manner. If the change impairs your ability to access Try It or the usability of Try It to more than a merely insignificant extent, we additionally inform you at least six weeks before the time of the change, on a durable medium, about the features and the time of the change as well as about your rights under the following two sentences. You may then terminate the contract free of charge within 30 days; the period begins when our information reaches you, and where the change is made only after the information has reached you, at the time of the change. This right of termination does not exist if the impairment is only insignificant or if your ability to access the unchanged product and its usability remain available to you at no additional cost. Your further statutory rights remain unaffected. This paragraph governs changes to Try It itself (§ 327r of the German Civil Code); changes to these terms are governed by § 14.
(7) We endeavour to maintain continuous availability. Maintenance work, disruptions at our service providers and events outside our sphere of influence may lead to interruptions. We announce planned maintenance in so far as that is reasonable for us.
§ 3 Your account
(1) You need an account in order to use the service. You register with your email address and a password and confirm the address via the link we send you. Before that, the account cannot be used.
(2) Your details must be correct and complete. If they change, you update them in your account.
(3) You may keep only one account. You must not pass on your access credentials and must not allow others to use your account. Keep your password in such a way that third parties cannot obtain it, and tell us if you have any indication that someone else has access to your account.
(4) Minimum age. You can create an account from the age of 16. If you are not yet 18 years old, you need the prior consent or the subsequent approval of your parents or your other legal representative, both for the contract on free use and for a paid subscription: both contracts impose obligations on you (paragraphs 2 and 3 as well as § 9) and grant us rights of use in your content (§ 8(2)); they are therefore not merely legally advantageous for you. We may require proof of that consent. If you buy the subscription through the App Store, the approval may also be given through the Ask to Buy request in Apple's Family Sharing.
§ 4 How the contract is concluded
(1) Free use. The contract on free use is concluded when you register, confirm your email address and we activate your account.
(2) Paid subscription through our website. The presentation of the plans on our pricing page is not yet an offer. You make your offer by clicking, in the checkout process, the button by which you expressly undertake to pay. Before that you see the total price including VAT, the term and the essential features of the service; in the case of the annual subscription you additionally see the minimum duration of twelve months and the monthly price that applies once it expires (§ 6(3)). We accept your offer by sending you the order confirmation by email or by activating the plan, whichever happens first.
(3) In the checkout process you agree to these terms and expressly request that we begin performing before the withdrawal period expires. We display the wording of this declaration to you there and repeat it in the order confirmation.
(4) We store the contract text. You receive it with the order confirmation in text form. You can call up and save these terms on our website at any time.
(5) Paid subscription through the App Store. § 15 applies to this.
(6) You can have only one paid subscription at a time. If an active subscription already exists, we reject any further order.
§ 5 Prices and payment
(1) The prices that apply are those stated on our pricing page or in the App Store at the time of your order. All prices towards consumers are total prices and include statutory VAT.
(2) In the case of a subscription through our website, the fee is due in advance at the beginning of each billing period. The payment methods available are those shown to you in the checkout process. We process the payment through our payment service provider; we remain your contractual partner for the subscription.
(3) Where you buy through the App Store, Apple bills through your Apple account; the contractual partner for that purchase is Apple Distribution International Ltd. § 15 sets out the details.
(4) If a payment fails to arrive, we inform you and set you a reasonable period. If that period expires without result, we may block the paid access until the amount is settled and terminate the contract for cause. Content you have already uploaded is retained during a block; § 13 remains unaffected. In all other respects, the statutory rules on default of payment apply.
(5) Price changes. For a billing period that has already begun and for the fixed term of an annual subscription, the agreed price remains unchanged. If we want to change the fee for future billing periods, we offer this to you in text form at least six weeks before the intended date and state in it the old and the new price, the date and the reason. The new price applies only if you expressly agree to it; your silence does not count as agreement. If you do not agree, the contract continues at the previous price; we may then terminate it on ordinary notice under § 6(4). For contracts concluded after a price change, the new price applies immediately.
§ 6 Term and termination
(1) Free use runs for an indefinite period. Either side may end it at any time without notice.
(2) Monthly subscription. It runs for an indefinite period and is billed monthly. You can cancel it at any time with effect from the end of the current billing period.
(3) Annual subscription bought from us. It has a fixed term of twelve months. You can cancel it at any time with effect from the end of that term. If you do not cancel, it then continues for an indefinite period as a monthly subscription of the same tier and is billed monthly; you can then cancel it at any time with effect from the end of the current billing period. From the switch onwards, the monthly price applies that we stated to you when you ordered the annual subscription for the monthly subscription of the same tier; this price does not change as a result of the switch. We state it to you before your order and repeat it in the order confirmation. At the latest one month before the twelve months expire, we remind you in text form of the switch, state that price to you once again and point out your right to cancel. If the first period is free of charge for you, the term nevertheless begins when the contract is concluded.
(3a) Annual subscription through the App Store. If you buy the annual subscription through the App Store, the term, the renewal and the price are governed by the contract concluded there and by the Apple Media Services Terms and Conditions; paragraph 3 does not apply to it. You can cancel this subscription in the settings of your Apple account; paragraph 7 and § 15 apply.
(4) We may terminate on ordinary notice of one month with effect from the end of a billing period.
(5) The right of either side to terminate for cause remains unaffected.
(6) How you cancel. For subscriptions you have concluded on our website, you reach the cancellation form via the button “Verträge hier kündigen” (German for “cancel contracts here”) or directly at tryit-app.com/kuendigen. You can reach the button “Verträge hier kündigen” from every page of our site: in the footer, in the header of our legal pages and in the menu of our web app. It is permanently available and can be reached without logging in. You can fill in the form without logging in and submit it with the button “cancel now” (German: „jetzt kündigen"). We confirm to you immediately in text form the content, the date and the time of receipt as well as the time at which the contract ends. Instead of this you can cancel in the customer portal or write to us informally in text form, for example to info@tryit-app.com.
(7) Subscriptions through the App Store are cancelled by you in the settings of your Apple account under “Subscriptions”. We cannot technically end such subscriptions for you. Deleting your Try It account does not end such a subscription. You can additionally declare the termination of your usage contract with us via our form at tryit-app.com/kuendigen. That termination ends your contract with us, but not the billing through your Apple account; for that you must cancel the subscription in the settings of your Apple account. We point this out to you again in our cancellation confirmation.
(8) Notices of cancellation or termination require text form; we do not require any stricter form.
(9) When a paid subscription ends, your account reverts to the Free tier, unless you delete the account. If your content then exceeds the limits of the Free tier, you can continue to view, download and delete it; you can create new items again only once you are below the limit.
§ 7 Right of withdrawal
(1) If you are a consumer, you have a right of withdrawal of 14 days for the distance contracts concluded with us, irrespective of the state in which you have your habitual residence and of the access route through which you concluded the contract. You declare the withdrawal to us; our contact details are in § 1(1). The details and the model withdrawal form can be found in the withdrawal instructions, which form part of this contract. You can also declare the withdrawal directly through our withdrawal function under paragraph 5; no login is required for this.
(2) Your withdrawal period is 14 days from the conclusion of the contract. Because in the checkout process you expressly request that we begin performing before that period expires, the following applies: your right of withdrawal does not expire early as a result. It continues until the 14 days have elapsed; before that it expires only if we have performed the service in full by then, which is not the case with an ongoing subscription. If you withdraw within the period, we owe you repayment of your payment and you owe us proportionate compensation for the value of the service performed up to the withdrawal. The basis of the calculation is the agreed total price, apportioned according to the time that has elapsed from the beginning of performance until your withdrawal reaches us; if the agreed total price is disproportionately high, we calculate on the basis of the market value of the service performed. For a period for which the contract provides for no payment — such as a free first month — you owe no compensation for the value. Moreover, you owe compensation for the value only if we informed you properly beforehand about your right of withdrawal and about this amount.
(3) Subscription through the App Store. If you buy the subscription through the App Store, the contract of purchase for it is concluded between you and Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland; that company is the merchant of record there. You therefore address your withdrawal from that purchase and any refund to Apple; for this purpose Apple makes available to you, in the Apple Media Services Terms and Conditions, its own withdrawal instructions together with a model withdrawal form. Which conditions apply to that withdrawal and when it is excluded is determined by Apple in those terms; there Apple provides for an exception in the case where delivery has already begun with your express consent and your acknowledgement of the loss of the right. We are not permitted to refund the amount paid via Apple ourselves. Irrespective of this, you can withdraw from us, under paragraph 1, from the contract on the use of Try It that exists between you and us; no payment to you follows from this, because you pay us nothing for that contract.
(4) Free use. If you are a consumer, you also have a right of withdrawal of 14 days for the contract on free use; it falls within the scope because you provide us with personal data for it (§ 312 paragraph 1a of the German Civil Code). You declare the withdrawal to us informally, for example to info@tryit-app.com, or through our withdrawal function under paragraph 5. No fee is charged for free use; there is therefore nothing to refund, and you owe no compensation for the value. Irrespective of withdrawal, you can end free use at any time under § 6(1) and delete your account under § 13.
(5) Withdrawal function. You can also declare your withdrawal directly through our withdrawal function. You can reach the button “Vertrag widerrufen” (German for “withdraw from contract”) from every page of our site: in the footer, in the header of our legal pages and in the menu of our web app. It is permanently available and can be reached without logging in, and it takes you directly to the form at tryit-app.com/widerruf-erklaeren. Once you have entered your details and clicked “Confirm withdrawal” (German: „Widerruf bestätigen"), we send you without undue delay a confirmation of receipt in text form containing the content of your declaration as well as the date and time of receipt.
§ 8 Your content
(1) Everything you upload or create in Try It — photos of your items of clothing, outfits, notes, travel plans — remains yours. We acquire no ownership and no copyright in it.
(2) So that we can perform the contract at all, you grant us a non-exclusive right of use in it, limited in territory to what is necessary and limited in time to the term of the contract. It extends exactly as far as the purpose of the contract and allows us:
- to store your content, to back it up and to keep it available for you,
- to process it technically in so far as the features require — in particular cutting out the background, cropping, converting size and format, tagging, and assembling it into outfits and export templates,
- to display it to you yourself and to the devices that are logged in to your account.
(3) The right of use goes no further than this. In particular, we do not make your content publicly available, do not pass it on to other users and do not use it for advertising, for references or for training AI models. If we want to do any of these, we ask you separately beforehand; you decide freely and can withdraw such consent at any time with effect for the future. You do not grant us types of use that do not yet exist today.
(4) If you export an outfit as an image and publish it yourself, for example on social networks, that is your publication and your decision. We are not involved in it.
(5) You warrant that you hold the necessary rights in everything you upload and that you do not infringe any third-party rights. This applies in particular to photos showing other people and to images you did not take yourself. If you breach this obligation, you are liable to us under the statutory rules.
(6) When the contract ends, we make no further use of your content. At your request, we make available to you, free of charge, without hindrance, within a reasonable period and in a commonly used, machine-readable format, the content that is not personal data and that you provided or created with Try It. Excluded is content that has no use outside Try It, that relates exclusively to your use, or that we have combined with other data in such a way that it can be separated again only with disproportionate effort.
§ 9 What you must not do
(1) You must not use Try It in order to
- store or distribute unlawful content,
- upload images of third parties in which you hold no rights, or recordings of other people without their consent,
- attack, circumvent or disrupt the security or availability of the service, in particular through malware, overloading or the circumvention of access and security mechanisms,
- access the service, read it out or extract content in an automated manner, in so far as we have not expressly permitted this,
- resell your access, rent it out or let third parties use it,
- circumvent the quantity limits of your plan, for example by using several accounts.
(2) If you breach this, we will as a rule first ask you to remedy the breach and set you a reasonable period for doing so. If that is not sufficient in view of the nature and severity of the breach — for example in the case of criminal content or an attack on the service — we may remove individual content, restrict features or temporarily block your account, including with immediate effect. In doing so we always choose the mildest means that effectively ends the breach, and we inform you of the measure and its reason.
(3) The right to terminate for cause remains unaffected. If we terminate for a reason for which you are responsible, we refund the fee for the unused part of the period already paid for; further claims on both sides remain unaffected.
§ 10 AI-assisted features
(1) Two features of Try It work with artificial intelligence: the automatic tagging of your items of clothing and the style advice Noé. Noé is an AI system; when you talk to Noé, you are not talking to a human being. We point this out to you before you use Noé for the first time (Article 50(1) of Regulation (EU) 2024/1689). We mark Noé's outputs as generated by an AI system (Article 50(2) of the same Regulation). Which features are available to you depends on your plan.
(2) Noé's answers are generated by an AI system. They are suggestions, may be incomplete or wrong, are not advice you can rely on, and are no substitute for professional advice. The same applies to the automatic tagging. You decide yourself what you do with it. You can correct recognisable errors in the tagging in your wardrobe at any time.
(3) For Noé, your chat inputs, your style profile and details of your items are transmitted to service providers that may process outside the European Union. Noé therefore runs only if you have expressly consented beforehand. Without consent, the rest of the app remains usable. You can withdraw your consent at any time with effect for the future; after that, Noé is no longer available. Which data goes to whom is set out in the privacy policy.
(4) If you withdraw a data protection consent or object to processing, the contract remains effective in all other respects. We do not raise claims for compensation on that account. If continuing the contract becomes unreasonable for us as a result, we may terminate it without notice.
(5) The automatic tagging of your items of clothing runs on our own systems. The cutting out of the background runs in the web app in your browser and in the iOS app on your device.
§ 11 Defects
(1) The statutory provisions on consumer contracts for digital products apply to defects, in so far as you are a consumer. We do not exclude your rights in respect of defects and do not limit them.
(2) If we fail to make Try It available without undue delay despite your request, you may terminate the contract.
(3) If Try It was defective during a period, our claim to the fee for that period lapses; we refund what has already been paid to that extent.
(4) If you are a trader, the statutory rules on defects of the law applicable to the contract apply.
§ 12 Liability
(1) We are liable to you without limitation
- for damage arising from injury to life, body or health that is based on a breach of duty by us, our legal representatives or our vicarious agents — already in the case of simple negligence,
- for intent and gross negligence on the part of us, our legal representatives or our vicarious agents,
- in so far as we have given a guarantee,
- under the German Product Liability Act (Produkthaftungsgesetz).
(2) In all other respects, we are liable in the case of simple negligence only where we breach an obligation the fulfilment of which is what makes the proper performance of the contract possible in the first place and on the observance of which you may regularly rely. In that case our liability is limited to the damage that was foreseeable at the conclusion of the contract and typical for this type of contract.
(3) There is no liability going beyond this; paragraph 1 remains unaffected. Paragraphs 1 and 2 also apply to claims against our employees, representatives and vicarious agents personally.
(4) This does not involve any change in the burden of proof to your detriment.
(5) Try It is no substitute for backups of your own. Back up images that are important to you yourself, in addition. We are liable for the loss of data in accordance with paragraphs 1 to 3. If you have failed to make a backup of your own that was possible and reasonable for you, and damage has arisen or increased as a result, the statutory rules on contributory negligence apply. Paragraph 4 remains unaffected.
§ 13 Deleting your account, end of the contract, data
(1) You can delete your account at any time. Deletion also ends the contract on free use.
(2) Deletion is final. We delete your wardrobe, your outfits and your uploaded images on our servers. The app removes local data on your device at the same time.
(3) If you only want to end your subscription and keep your account, you cancel it under § 6. You can, however, also delete your account while a paid subscription is running. If you concluded the subscription on our website, we end it immediately when you delete your account, even if you have already cancelled it. After that, we will not charge you anything further. Paid time that has not yet run out by then lapses without a refund. We point this out to you before the deletion, together with the end of your paid period. Deleting your account does not, however, end a subscription through the App Store; for such a subscription, deletion is not a cancellation. Billing continues through Apple until you cancel the subscription in the settings of your Apple account. You should therefore cancel it before deleting your account; we point this out to you beforehand as well.
(4) We are required by law to retain commercial and tax records relating to your payments. On deletion we separate them from your account and retain them for the statutory period. The details are set out in the privacy policy.
(5) After the contract ends, you may no longer use Try It. We may technically prevent further use. Your right under § 8(6) to receive your content remains unaffected by this.
§ 14 Changes to these terms
(1) We may change these terms in so far as this does not shift the relationship between performance and consideration to your detriment and no principal contractual obligation is changed, and only where one of the following valid reasons applies: a change in the law or in the case law of the highest courts, a judgment or an administrative order, the invalidity of one of these provisions or a gap arising as a result, or an event that we have not brought about and over which we have no influence — such as the discontinuation of a service provider we need for the service. No other reasons entitle us to change these terms. Changes to Try It itself are governed by § 2(6).
(2) We notify you of every change in text form at least six weeks before it takes effect and make available to you the new wording as well as an overview of the changes. Until it takes effect you can terminate the contract with effect from that date. In the notification we point out both this right of termination and, expressly, what it means if you do not terminate: if you do not terminate, the amended version applies from the stated date for the future. Paragraph 3 remains unaffected.
(3) Changes that affect the relationship between performance and consideration or that concern a principal contractual obligation take effect only if you expressly agree to them. Your silence does not count as agreement. If you do not agree, the contract continues unchanged; we may then terminate it on ordinary notice under § 6(4).
(4) For contracts concluded after a change takes effect, the new version applies immediately.
§ 15 Particularities where you obtain the app through the App Store
(1) When this section applies, and between whom the contract exists. Paragraphs 2 to 7, 9 and 10 apply to the use of the Try It app that you obtain through the App Store. Paragraph 8 applies as soon as we offer a paid subscription in the App Store; for as long as we do not do so, no subscription can come about through the App Store, and the provisions of these terms on purchase through the App Store (§ 1(5), § 2(3), § 4(5), § 5(3), § 6(3a), § 6(7), § 7(3)) have no effect until then. The contract on the use of Try It is concluded exclusively between you and us, not with Apple. Apple is not responsible for it. We alone are responsible for the app and its content, not Apple.
(2) Scope of the licence. We grant you a non-transferable right to use Try It on Apple devices that you own or control, within the framework of the Usage Rules of the Apple Media Services Terms and Conditions. Through Family Sharing or volume purchasing programmes, other accounts associated with the purchaser may also access the app.
(3) Maintenance and support. Maintenance and support for Try It are provided by us alone. Apple has no obligation whatsoever in this respect. Address questions, complaints and claims concerning the app to us: Ariside UG (haftungsbeschränkt), Lindenweg 20, 39326 Zielitz, phone +49 1579 2529052, email info@tryit-app.com.
(4) Warranty. We alone are responsible for the warranty. If Try It does not conform to an applicable warranty, you may notify Apple; Apple will then refund you the purchase price for the app. Beyond that, to the maximum extent permitted by law, Apple has no further warranty obligation. All other claims, losses, liabilities, damages, costs and expenses that are attributable to a failure to conform to a warranty are our sole responsibility. Your statutory rights vis-à-vis us remain unaffected.
(5) Claims relating to the product. We alone, not Apple, are responsible for claims that you or third parties assert in connection with Try It or your possession and use of Try It. This applies in particular to product liability claims, to the allegation that Try It does not comply with a legal or regulatory requirement, and to claims under consumer protection, data protection or similar provisions. This does not limit our liability towards you any further than the applicable law permits; § 12 applies.
(6) Third-party intellectual property rights. If a third party asserts that Try It or your possession and use of Try It infringes its intellectual property rights, we alone, not Apple, undertake the investigation, the defence, any settlement and the discharge of that claim.
(7) Export assurance. You warrant that you are not located in a country that is subject to an embargo imposed by the U.S. Government or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
(8) Billing, cancellation, refund. If you buy the subscription in the App Store, Apple bills through your Apple account. The subscription renews automatically at the price applicable at the time until you cancel it; billing takes place no earlier than 24 hours before the beginning of the next billing period. You can cancel at any time in the settings of your Apple account under “Subscriptions”; the cancellation takes effect at the end of the current billing period. Your subscription applies on all devices that are logged in with the same Apple account. You apply to Apple for a refund of the amount paid via Apple; only Apple can provide it. Under the Apple Media Services Terms and Conditions you can also cancel a subscription at any time with immediate effect and request a proportionate refund; this right exists vis-à-vis Apple. You address your withdrawal in accordance with § 7(3).
(9) Third-party terms. When using Try It you must comply with the applicable third-party terms, for example the terms of your mobile or data plan.
(10) Apple as third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple has the right — and is deemed to have accepted that right — to enforce these terms against you as a third-party beneficiary.
§ 16 Final provisions
(1) Choice of law. The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer and have your habitual residence in another state, this choice of law applies only in so far as it does not deprive you of the protection granted to you by the mandatory provisions of the law of your state of residence.
(2) Place of jurisdiction. If you are a merchant (Kaufmann), a legal person under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our registered office. We may also sue you at your general place of jurisdiction. For consumers, the statutory places of jurisdiction apply.
(3) Set-off and retention. You may set off with claims that are undisputed or have been finally determined by a court. You have a right of retention in so far as it is based on the same contractual relationship.
(4) Form. Declarations relating to this contract require text form; you can, however, declare your withdrawal to us informally (§ 7). We do not require any stricter form. A declaration by us is not deemed to have reached you merely because we have sent it.
(5) Assignment. You may transfer your rights and obligations under this contract to a third party only with our consent in text form. You may freely assign monetary claims against us.
(6) Invalid provisions. If a provision of these terms has not become part of the contract in whole or in part, or is invalid, the contract remains effective in all other respects. The statutory provisions take the place of the provision that was not incorporated or is invalid.
(7) Consumer dispute resolution. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer dispute resolution entity (Verbraucherschlichtungsstelle).

39326 Zielitz
Alemania Administrador: Christopher Kohn
(3) Rigen frente a consumidores y frente a empresarios.
§ 2 Qué presta Try It
(2) Try It tiene tres niveles:
Borrar prendas no libera espacio.
(3) Suscripción anual comprada a nosotros.
(1) No puedes usar Try It para
Tus derechos legales frente a nosotros quedan intactos.
